10) RESPONSIBILITIES

2.1. Flamorah is an online store selling a variety of high quality women's accessories products at prices that suit all age groups.

2.2. Flamorah 's services are provided in accordance with laws in force in the Kingdom of Bahrain .

2.3. This policy shall be a valid contract satisfying the legal elements and shall be enforceable against everyone who uses the Flamorah services. 6.2.3. If your actions have caused any loss or liability to us or our users.

6.2.5. If we see any other violations in any other circumstances.

6.3. The user who is excluded or suspended from membership is not entitled at any time to do or attempt to register or use the Flamorah site in any way.

In the event that we fail to take any actions against any violations by you or anyone else, this does not mean a waiver by Flamorah administration of its right to take any legal actions regarding those violations, and Flamorah does not guarantee such action against all possible violations of this policy.

8.1.7. Submit files that contain material that could be considered harmful, scandalous, pornographic, sexually explicit, indecent, vulgar, violent, offensive, insulting, threatening, harassing, hateful or unacceptable.

8.1.8. Publish, submit or insert any material containing viruses or other harmful software or any malicious code, files or other software designed to damage, interfere with or identify the normal operation of the service (or any part thereof), or any other software or computer hardware.

8.1.9. Collecting or tracking the personal information about the users.

8.1.10. Tampering with data and information, and attempting to modify or destroy any security or documentary procedures.

8.1.11. Attempting to gain unauthorized access to the site or any networks, servers or computer systems connected to the site.

8.1.12. Modify, copy, adapt, translate, extract the source code or reverse engineer any part of the site, make any derivative versions or re-format or frame any portion of the pages comprising the site, save to the extent expressly permitted in this policy or by law.

8.1.13. Infringement of any trademark, copyright or other proprietary rights of any party, or content that you do not have a right to make available under any law or under contractual relationships.

8.2. You acknowledge and agree that your failure to abide by any of the foregoing may result in the immediate termination of your account or any services provided to you – with or without notice, and without any refund of amounts paid on account of any such services.

9) PURCHASE POLICY

9.1. Users who can legally enter into online contracts are entitled to purchase products from Flamorah.

9.2. When choosing the product to purchase, you must follow the instructions for placing the order before submitting it and completing the payment.

9.3. You must pay for the products you purchase with one of the approved payment methods available on the site.

9.4. When you place an order and complete payment with one of the cards, you agree that you have the right to use these credit cards at the time of payment, that they contain sufficient funds, credit or other payment facilities to cover the purchase, and you agree that the Flamorah site is entitled to verify payment methods, for example, credit card number and validity, and you will receive an email order and shipping confirmation, which may be rejected in the following cases:

9.4.1. Unavailability or readiness of order at the time of purchase.

9.4.2. Providing a credit card that has been stolen or you do not have the authority to use it.

9.4.3. There are errors in product specifications, price or images.

9.5. If you make a mistake during the purchase process, you must immediately contact the site's customer service. Please note that we do not guarantee that we will be able to amend your order.

10) PAYMENT POLICY

10.1. All fees and prices on the Flamorah site shall be in Bahrain Dinar.

10.2. Flamorah site provides payment for the purchase of products by the following means:

10.2.1. Bank cards.

10.2.2. Cash on receipt

10.3. All transactions made through E-transactions are due immediately.

10.4. All information and data you enter through the e-payment gateway are encrypted for the purpose of security protection, and the current correspondence is encrypted to and from the service provider.

10.5. Flamorah site shall not be liable for any user’s error in the payment process, nor does it be liable because of piracy or fraud process on the internet.

10.6. The buyer must make sure that the information entered in the payment is correct, accurate and valid before completing the payment process.

10.7. The buyer must use his own bank cards, and if he uses one of the cards for another party, he must have an authorization or permission to use it, and thus Flamorah shall not be responsible towards any party as a result of using his credit cards.

11) LEGAL DISCLAIMER

11.1. Unless expressly expressed in this Policy and to the fullest extent permitted by law, the Website is provided on an “as is” and “as available” basis, and Flamorah makes no warranties or representations of any kind whether express or implied with respect to the Website or services available, merchantability, convenient for a particular purpose, compatibility, security, accuracy, reliability or completeness of any content, information, software, text, images, links or communications provided by site or through the use of the site.

11.2. Flamorah endeavors to do its best ability to ensure that the site is available for use, but does not be liable for any possible interruptions of the service due to, but is not limited to, maintenance work, technical problems or other similar causes, and shall not be liable for damages, which may be caused by operation failure of the site.

11.3. Flamorah shall not be liable for any personal acts, any violation of the rights of privacy or any intellectual property rights.

11.4. Flamorah shall not be liable any legal liability arising from the acts of the users or others, as each user deals with the site on his own responsibility without any legal liability towards us, whether it was civil, criminal, jointly or ancillary liability, therefore you directly exempt us from any liability arising from the acts of the site user.

15) INDEMNIFY

15.1. As a user of the site, you agree to indemnify Flamorah and any of its directors, officers, employees, and agents from all claims, liabilities, losses, damages, fines, costs or expenses of kind or nature (including legal fees and attorney's fees), that arise or may arise out of, or in relation to:

16.1. 17) TERM AND TERMINATION

17.1. The term of this Agreement commences from the date you register an account or use the site and acknowledge your acceptance of it and will continue in effect until terminated by you or Flamorah site.

17.2. We may terminate this agreement at any time without notice if you violate any of Flamorah’s policies.

17.3. Upon termination, all rights granted to you under this agreement will also terminate, you will not be allowed access to your account or service, you must immediately cease using the service, you must pay Flamorah any amount due prior to termination, and all payment obligations due prior to termination will remain valid.

18) NO WAIVER

18.1. You may not assign your obligations and rights under these terms or authorize another party to manage your account except after getting a written consent from us, and failure or delay by us to enforce any of this policy will not constitute a waiver of our rights against you and does not affect our right to require future performance thereof.

19) MODIFICATION

19.1. Flamorah may revise and update this policy from time to time in its sole discretion.

19.2. All modifications are effective immediately when posted and apply to all use of the site thereafter.

19.3. Your continuity of using Flamorah site after updating this policy shall be deemed to be an express consent by you to these modifications and a legal acceptance of the new terms and conditions, and you agree that all previous versions of these policies are superseded by the modified version.

20) GOVERNING LAWS/JURISDICTION

20.1. This usage policy and other policies shall be governed by the laws of the Kingdom of Bahrain.

20.2. The Bahrain courts shall have jurisdiction over any dispute that might arise from the interpretation or performance of this policy.

20.3. If any of this policy shall be deemed unlawful, void or unenforceable under applicable laws, that condition shall be deemed severable and shall not affect the validity and enforceability of the remaining conditions.

21) LANGUAGE

These policies are drafted in Arabic language; the Arabic text shall be deemed the certified text in relation to the interpretation of these terms and applicable before all the official and unofficial bodies if the English language conflicts with it.

22) CONFLICT

In the event of any conflict between this policy and any prior versions thereof, the current version shall prevail unless it is expressly stated otherwise.

23) ENTIRE AGREEMENT

This policy and any policies or operating rules posted by us on the site or in respect to the service constitutes the entire and final agreement between Flamorah on one hand, and any person visiting or using the site on the other hand, superseding any prior or contemporaneous agreements, communications or prior versions of these policies.
